All references in this Washington Policy to “Grindr”, “we”, “us”, or “our”, refer to Grindr LLC, its parent companies, and its subsidiaries such as Grindr Canada Inc. This Washington Policy explains how Grindr Processes the Consumer Health Data (as defined by MHMD Act) of Washington residents and individuals whose Consumer Health Data is Collected in Washington (collectively, “Consumers”). This Washington Policy covers these activities across all of our properties (“Properties” or “Grindr Properties”), as defined in the <a href="https://www.grindr.com/privacy-policy" >Grindr Privacy and Cookie Policy</a >.This Washington Policy supplements the disclosures in our Grindr Privacy and Cookie Policy to provide specific disclosures required under the MHMD Act. In the event of a conflict between any other policy, statement, or notice and this Washington Policy, this Washington Policy will prevail as to Consumer Health Data Collected under the MHMD Act.Capitalized terms that are not otherwise defined in this Washington Policy shall be defined as they are in the MHMD Act.<h2>I. We use Precise Location Information to provide products or services you requested, including to:<ul><li>Display your distance to other users within the Grindr community based on approximate distance</li><li>Allow Consumers to share location with others who are part of the Grindr Community and discover other users’ location</li><li>Respond to specific customer requests and inquiries, including customer support</li><li>Troubleshoot and improve the product or service</li></ul></td></tr><tr><td colspan="1" rowspan="1">Photographs (such as Profile or Album pictures) that may contain images of a Consumer from which a biometric identifier template could be extracted</td><td colspan="1" rowspan="1">From you when you choose to enter information into the Grindr Properties</td><td colspan="1" rowspan="1">Grindr does not create biometric identifier templates from photographs. We use audio and video recordings to provide products or services requested, including to:<ul><li>Allow Consumers to share recordings with other users who are part of the Grindr Community in order to facilitate user connections</li><li>Respond to specific customer requests and inquiries, including customer support</li><li>Troubleshoot and improve the product or service</li></ul></td></tr><tr><td colspan="1" rowspan="1">Health Information, including the categories described above or any other health information that a consumer decides to self-disclose</td><td colspan="1" rowspan="1">When you provide information in response to a user research study</td><td colspan="1" rowspan="1">Improve the Grindr Properties and communicate with you in response to your feedback</td></tr></table>We may use any of the above categories of Consumer Health Data to prevent, detect, protect against, and respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or any activity that is illegal under Washington state or federal law; preserve the integrity and security of our systems; investigate, report, or prosecute those responsible for any illegal action under Washington state or federal law; and as otherwise permitted or required by law.<h2>II. Sharing Consumer Health Data</h2>We may Share Consumer Health Data with third parties where we obtain consent from the Consumer for another purpose.We Share Consumer Health Data among our Affiliates to carry out our operations and provide services to Consumers. These Affiliates include: Grindr Canada Inc.We may Share any of the above categories of Consumer Health Data to prevent, detect, protect against, and respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or any activity that is illegal under Washington state or federal law; preserve the integrity and security of our systems; investigate, report, or prosecute those responsible for any illegal action under Washington state or federal law; and as otherwise permitted or required by law.We do not Sell Consumer Health Data. In the event this changes, we will not Sell Consumer Health Data without first obtaining valid authorization from the applicable Consumer.<h2>III. Consumer Health Data Rights</h2>Consumers have the right to submit certain requests relating to your Consumer Health Data as described below.The easiest way to exercise your rights while protecting your privacy and security is by logging into your account so we can verify your account ownership. You can also make a request outside of your Grindr account by clicking <a href="https://help.grindr.com/hc/en-us/requests/new?ticket_form_id%3D360006692913" >here</a >, but then we’ll require some additional information to authenticate your identity and ownership of your account.Consumers have the right to:<ul><li>Confirm whether we are Collecting, Sharing, or Selling your Consumer Health Data;</li><li>Access your Consumer Health Data;</li><li>Request that your Consumer Health Data be deleted; </li><li>Withdraw Consent from our Collection and Sharing of your Consumer Health Data; and</li><li>Obtain a list of all Third Parties and Affiliates with whom we have Shared your Consumer Health Data and an active email address or other online mechanism to contact these parties.</li></ul>If you choose to exercise any of your privacy rights, we will not discriminate against you.You may be able to appeal a decision made regarding your privacy request by submitting a request <a href="https://help.grindr.com/hc/en-us/requests/new?ticket_form_id%3D360006692913%26tf_360056453953%3Dform__privacy_request__privacy_appeal" >here</a >. In the event we deny your appeal, we will provide a written explanation of the decision, and instructions on how to contact your local Attorney General for further review.<h3>Nevada Consumer Health Data Privacy Policy</h3>This Nevada Consumer Health Data Privacy Policy (“Nevada Health Data Policy”) explains how Grindr Processes the Consumer Health Data of Nevada residents and individuals whose Consumer Health Data is Collected in Nevada (“Nevada Consumers”) pursuant to the Nevada Consumer Health Data law (“Nevada Law”). This Nevada Health Data Policy covers these activities across our Grindr Properties. Capitalized terms that are not otherwise defined in this Nevada Health Data Policy shall be defined as they are in the Nevada Law.In the event of a conflict between any other policy, statement, or notice and this Nevada Health Data Policy, this Nevada Health Data Policy will prevail as to Consumer Health Data Collected from or about Nevada Consumers.For the purposes of this section, “Nevada Consumer Health Data” means personally identifiable information that is linked or reasonably capable of being linked to a Nevada Consumer and that a Regulated Entity uses to identify the past, present or future health status of the Nevada Consumer. We Share Consumer Health Data among our Affiliates to carry out our operations and provide services to Consumers. We do not Sell Consumer Health Data. In the event this changes, we will not Sell Consumer Health Data without first obtaining valid authorization from the applicable Consumer.Third Parties do not Collect Nevada Consumer Health Data over time and across different Internet websites or online services when a Consumer uses the Grindr Properties.Nevada Consumers have the right to submit certain requests relating to your Consumer Health Data, specifically Nevada Consumers have the right to:<ul><li>Confirm whether we are Collecting, Sharing, or Selling your Consumer Health Data;</li><li>Request that we cease Collecting and/or Sharing your Consumer Health Data; </li><li>Request that your Consumer Health Data be deleted; and</li><li>Receive a list of all Third Parties with whom we have Shared your Consumer Health Data.</li></ul>Nevada Consumers that have been denied one of the above enumerated rights have the right to request an appeal. If you choose to exercise any of your privacy rights, we will not discriminate against you.
